Obstructing dropped kerbs

I'm being fined for slightly obstructing my mother's neighbour's dropped kerb on Monday .I knew I was slightly over the edge but there was ample room for him to get his 13 reg Jaguar in as he did indeed get onto his drive while I was still parked there ... Seems he went indoors and phoned the Council .This is an extra wide dropped kerb serving 2 houses .£55 if I pay in 21 days ,£110 if not .I'm thinking of challenging it on the basis that I didn't cause an obstruction as he got onto his drive.I never knew this was an offence .I thought you had no right to demand no one parks outside your house ,Shall I pay up or fight it?
One thing's certain I'm going to have words with them on Monday . Friendly relations have ended .

Is there photographic evidence of you obstructing the drive enclosed with the fine? If not are they just taking the word of the person who said that you were causing an obstruction? If they have proof that your wheels were across the dropped kerb then I think you'll end up paying, if it was just overhang I don't think that counts.
I think if your dropped kerb is totally obstructed you can have the offending car towed away if you can't get out, but not if you can't get in.

All or any of the above might be total lobbox though....

I get the same thing all of the time here...

Blimey, I haven't seen the PErjerous PIle of POOh website for a few years. I spent a few years on there fighting speed camera partnerships :shock:

The offence is called obstruction and I have been subjected to it from the other side, i.e. people blocking my drive so that I could not get my car out. They always claimed that a good driver could get his car out and that I was causing trouble for the sake of it. We eventually moved house because of it.

My local council won't do anything in less than a month, and neither will Beds Police.

At the moment, I've got one of my P6s parked on the kerb outside my house which gives me about a foot of kerb before my driveway. Otherwise I can't get off of my drive in the morning due to the asshole across the road constantly parking over my drop-kerb.
 
i get the same , getting blocked in when its work time etc
i have a drive too!
yup, its my other half and if you leave her 5 spaces she parks in the middle of them alll!
i'm off to weymouth to visit my mum now and there's not enough road to park in.
too many cars per household i'm afraid.mind they all have one space outside and the houses are 5-7 bed letting houses,
not sure how you deal with it but bad parking is infuriating and you just have to be considerate.
just never obstruct a jcb!
 
I asked one of the perpetrators to stop doing it and just got a load of verbal abuse. So I stated that if she parked across my drive once more, that I would get the police involved and have her prosecuted for obstruction. I was calm and collected about it, but her father (all 22 stone of him) came down the hill ranting about me having a go at his daughter, I said, "Look, all I am ask...." That's all I managed as he accelerated and shoulder barged me, catching me off guard so that I went backwards and fell into the wall in the front of my shop.

I had moved into Sheffield from Dorset, and was not used to this sort of violent behaviour so was quite shocked by this :shock:

He then continued to rant that he and his family would park wherever they F&^*ing liked. His wife and son-in-law had now arrived and he then shouted that I could call the police if I liked but his family would back him up and say that I had caused the problem by verbally abusing his family. He also threatened Sparky, who had been blocked in.

I stood up and walked over to him stating that I was going to call the police, and that if his family didn't stop trying to circle around me, that they would also be prosecuted for threatening behaviour. He started saying that it would be my word against theirs again, but then I pointed out that he had assaulted me in front of two video camera on the corners of my shop, and he then backed off. The police rushed round (5 hours) and arrested him, got the video footage (which included sound) but decided to let him off with a warning.

This is why I moved out and partially why I have no respect for the law.

I agree with the fine by the way, don't obstruct other's right of way.
 
on second reading your thread Dave you may be best off not having words with your mums neighbours unless you go and opologise for any inconveinience you've caused, say you didn't realise what you'd done and be humble.
you may think you're innocent but the neighbour and the council think you're not and you do actually admit to it.
not knowing obstruction is an offence is no defence either because you should know that.
you are unlucky being fined though, i could walk around the estate opposite me and find lots of examples of similar offences.
best to make peace though for it'll only escolate into silliness and there's more to life.
the age of his car is immaterial by the way so just compliment him on it, he may also like your's and hey pesto you have a friend!

No sympathy I'm afraid. If there wasn't enough room you should've found somewhere else to park where there was.

I suspect some people don't know what parking in London areas is like . When I was working I was covering areas near Heathrow where you'd be lucky to find a space to park . I never deliberately blocked anyone's drive . I always made sure they have room to get in / out as was the case here . The neighbour got onto his drive so he couldn't have been obstructed. I've got 2 garages and a double dropped kerb and I wouldn't throw a tantrum if someone was over it by 12".
I'll see if I can appeal this without risking the fine increasing .My friendly AA man says I can

Just to top it off this AM I was taking the dog to the park when she caught short and did a no. 2 on the pavement .I picked it up and a woman said I'd missed a bit . I explain the difficulty in getting residue out of the tarmac and she said I should use a tissue ! Saying I didn't have any she suggested I went to the shops and got some. My reply was 2 words , one syllable each.She wasn't happy !

Sorry Dave, but the excuse that parking is shit, and it's hard to find a parking space doesn't wash. The guy across the road from me who is constantly blocking either myself or my neighbour in says the same thing. I know that we have houses where you can fit maybe two cars on the drive, and another in the road - however - if you have three or four cars per household as your 20-something kids all have them, it doesn't justify blocking others in or parking over the edge of their drop-kerb even if only by an inch.

Same re your dog. I don't want to see dog shit on the pavement or the bottom of my shoe, even if it's just a little bit of residue. You might check your shoes every time you walk into your house, or get into your car, because you expect to have shit around, but I don't and nor do I want to because others can't control the rear end of their pets.

I often wonder why people post their personal woes on a public forum? I guess for some it may be the only, or the majority of, contact they get with society, but you just open yourself up to all sorts of comments and then it all gets very messy.

so to old charm's still not working then!
picking up dog pooh and makes people do odd things.
in the new forest you don't have to pick it up but some people do which is fine.
then they hang it on trees, bushes or their tow bar or run over the bags in the car parks??
i can never understand this behaviour.
amazingly i have been to London.i got rather told off for unloading once in the bank area by a posse of bike cops ! it was all under cctv cameras at the time due to the threat of car bombs
i got done! but i learnt
2 lads on the firm went to work in the london docks from Salisbury but couldn't park so they came home all the way to Salisbury??
one was the boss's son in law so they weren't sacked!
parking is a pain in the bum and not just restricted to London
usually when i visit in Weymouth i have to park 2 roads away from my mums.
it used to really get to me but now i accept it and an happy when i can park closer, its a bonus!
her neighbour has one parking space, 4 cars and a recovery truck!and is a complete arse!
actually , no parking space cos its the road outside,
chill out, obey the rules and then no one will have a pop at you!
its far less stressful

You can & should appeal every council-issued ticket. As long as you do it within the fourteen day reduction period, the ticket will then be put on hold until the council have informed you of their decision. If they don't accept your appeal (likely), you'll then have a further fourteen day period to pay the fine at the reduced amount or take your appeal to PATAS.
